National Council Did No Wrong – Hon. Boakye Agyarko Told

I say, and insist that, the rules of the game, contrary to the claims by Boakye Agyarko, have not been changed midway. When the Regulation of the elections committee (which itself is suspect because it wasn’t approved by council) talks about rerun, it doesn’t specify the form and nature of the rerun.

National Council, the superior body, and indeed, the highest decision making body of the party aside national conference, has come out to clarify the nature and form of the said rerun.

Again, the National Council decision is grounded not only in Article 18 but also, Article 10(3)(1) of the party constitution, which enjoins the body (i.e. National Council) to direct the affairs of the party (subject only to national conference) having regard to the interest and wellbeing of the party.

I submit to you that it is not in the interest of the party to organize yet another nationwide primaries to break this tie in respect of candidates at the bottom considering also that some of the super delegates (from our external branches) have left the jurisdiction. There is absolutely no propriety in such decision, be it politically, economically or even legally.

The party constitution, which to me, is sui generis, is unable to contemplate every possible future scenario and provide for same. That is why the framers of the constitution put in Article 18, to allow the party to fill in the gaps as appropriate without having to go through the rigorous process of amendments. This is a principle of constitutional interpretation. You may want to read the memorandum to the Interpretation Act.

Hon Agyarko, please, if you are looking for a reason to withdraw from the contest considering that you secured only 9 votes out of a possible 900+ votes (constituting less than 1%) in last Saturday’s special electoral college , kindly look for another reason. Certainly, you cannot legally fault the decision of the National Council, let alone to use same as a basis for your “chickening out” of the contest.
