Lawyers for Minority leader, Cassiel Ato Forson have submitted a supplementary affidavit supporting their motion for an order of mistrial, injunction, and/or stay of proceedings in the ongoing ambulance case.
This follows the release of a trending recording of a telephone conversation between Mr. Jakpa and Attorney-General Godfred Dame, which allegedly contains evidence of criminal and prosecutorial misconduct by the AG.
The affidavit also references certain quotations from media reports, particularly by Asaase Radio, that suggest professional misconduct by the Attorney-General.
These reports have been cited and annexed to the affidavit.
Ato Forson is urging the court to declare a mistrial, emphasizing that justice must not only be done but also be seen to be done.
He argues that the Attorney-General has engaged in reprehensible and unlawful conduct, unbecoming of his position, with the sole aim of securing Forson’s conviction.
The lawyers for the Minority leader contend that proceeding with the trial despite these serious allegations would constitute a travesty of justice, as it would disregard credible claims of misconduct by the Attorney-General.
They assert that ignoring such blatant disregard for the rule of law and ethics of prosecution would undermine public confidence in the administration of justice.
