Ghana Premier League club, Accra Hearts of Oak has been ordered to pay more than GHC100,000 in compensation to Mr. Charles Kwarteng, the former General Manager, Commercial and Merchandising.
The court presided over by Mrs. Anna Akosua Appiah Gottfried Anaafi Gyasi, upheld the plaintiff’s demands of compensation for salary arrears and fuel allowance arrears, among others.
It is worth noting that Mr. Kwarteng was under contract of employment from August 2019 until his resignation in September 2021.
In his writ of summons filed in April 2022, the plaintiff, Mr. Kwarteng, asked the courts to order the defendant to pay outstanding arrears while Hearts of Oak also filed a statement of defence.
Hearts of Oak, in their defence, denied the claims of the plaintiff’s claims and averments in general and made some general admissions that Mr. Kwarteng was not entitled to the reliefs.
But according to the courts, Mr. Kwarteng was entitled to the reliefs he sought following his resignation as the general manager in September 2021.
“The evidence supports the plaintiff’s claims, and I find that he is entitled to the reliefs he seeks.
“The defendant, on the other hand, has not been able to satisfy this court that it is entitled to the reliefs in its counterclaim; as such, its action fails,” excerpts of the judgement said.
The breakdown of the reliefs includes compensation of 50,000 to the plaintiff for using his private vehicle for official work, GHC 24,650 for the 17 months of arrears for fuel, and salary arrears of GHC 10,974.
Others include legal fees of GHC 20,000 and payment of Tier 2 deductions for 24 months.
