Former Special Prosecutor Martin A. B. K. Amidu has fingered his successor, Kissi Agyebeng, of attempting to deceive the public regarding the freezing and subsequent defreezing of bank accounts belonging to Cecilia Abena Dapaah.
Amidu’s accusations come in the midst of an ongoing legal battle, with the former prosecutor claiming Kissi Agyebeng’s actions amount to an abuse of the court process.
He expressed his disbelief and dismay, stating, “I could not believe my eyes when I read on Ghana Web the Special Prosecutor’s attempt to con the media and the public by assuming the power to de-freeze five (5) bank accounts out of a number of bank accounts contained in his own application pending in the High Court…”
According to Amidu, Agyebeng’s attempt to defreeze the mentioned bank accounts is in direct violation of due legal procedure.
He emphasized that the matter is already sub judice before the High Court, and the appropriate course of action would have been for Agyebeng to seek court approval for the defreezing.
In his scathing critique, Amidu accused Agyebeng of avoiding the adversarial process of the High Court.
“Kissi Agyebeng is running away with his tail between his legs from the adversarial process of the High Court even in matters which are sub judice,” he remarked.
He further questioned Agyebeng’s motives, suggesting that the Special Prosecutor’s actions have left room for speculation among rational citizens.
He urged Cecilia Abena Dapaah’s legal team to hold Agyebeng accountable for his conduct in open court after the Chief Justice’s directives have been implemented and the substantive case, filed on 11 September 2023, proceeds.
Highlighting the seriousness of the situation, Amidu emphasized that the role of Special Prosecutor does not grant immunity from legal procedures.
“Mr. Kissi Agyebeng needs to be reminded that the public office of Special Prosecutor is not akin to his former status as counsel for the anti-corruption entrepreneurial Tiger Eye PI where no law governs its operations,” Amidu added.
