Nana B Sues Mahama over Public Sector Dismissals

The National Organiser of the opposition New Patriotic Party (NPP), Henry Nana Boakye has sued the John Mahama administration challenging the unlawful termination of appointments for individuals employed before and after the December 7 elections.

Nana Boakye in a suit filed at the court wants the Supreme Court to declare that the directive from the Office of the President dated 10th February 2025 and signed by the Chief of Staff to Heads of government institutions to annual all appointments and recruitments made on the Public Service after 7th December 2024 is unconstitutional as the Chief of staff lacks the power to give such directive.

Mr Boakye contended that the directive violates Article 191(b) of the 1992 Constitution, which protects public service employees from dismissal without just cause.

He maintains that neither the Chief of Staff nor the President has the power to arbitrarily revoke legally sanctioned appointments.

As part of his reliefs, Mr Boakye is asking the Supreme Court to declare the directive null and void, prevent government institutions from enforcing it, and affirm that the President is bound to uphold constitutional protections for public sector employees.

He is also seeking an order to cover legal costs.

It may be recalled that President Mahama speaking through the Chief of Staff, Mr. Julius Debrah issued a directive revoking all public service appointments and recruitments made after December 7, 2024.

A confidential letter containing the directive said “Consistent with Government pronouncement in relation to near end of tenure appointments and recruitments, I wish to bring to your attention that all appointments and recruitments made in the Public Services of Ghana after 7th December, 2024 are not in compliance with established good governance practices and principles.”

“Accordingly, all Heads of Government Institutions are hereby requested to take the necessary steps to annul any such appointments or recruitments and submit a comprehensive report on the actions taken to this Office by 17th February 2025. Your cooperation in this matter is highly appreciated,” the letter read.
