The Minority National Democratic Congress (NDC) in Parliament is preparing to file a stay of execution at the Supreme Court on the passage of the controversial Electronic Transfer Levy (E-Levy).

The NDC MPs will pray the apex court to declare the passage of the bill by a one-sided House of less than 138 MPs null and void.

The Caucus wants the President to be estopped from signing the E-Levy bill into law pending the determination of the case.

The side argues the bill hasn’t been passed contrary to claims by the majority that it has been passed.

They argue the walkout invalidates whatever decision Parliament took since the House didn’t form a quorum as stipulated in the 1992 constitution and enforced by a recent Supreme Court ruling.

Article 104 (1) constitution says a quorum can only be formed by at least half of the 275 members of parliament.

With Dome-Kwabenya MP, Sarah Adwoa Safo still out of the jurisdiction, the number of MPs present in the chamber after the minority walked out was not up to 137.5 members needed to form a quorum.
